Il giornalista “collaboratore fisso” e la tutela della sua professionalità tra autonomia e subordinazione

The essay dwells on the conspicuous jurisprudence concerning the correct qualification of the journalist as a subordinate worker. The intention is to identify the different criteria that could qualify the so-called “Collaboratore fisso” as a subordinate worker instead of being defined as a selfemployed one. Taking into consideration the particular aspects of the performance that characterize the “collaboratore fisso” - such as the absence of working time or the possibility to perform the activity wherever he wants - the Supreme Court repealed two criteria that help in his qualification: the participation in the publication of the journal and the management of an editorial column.
