This essay offers reflections on the work of art as a form emerging from an operation of observation. Subsequently, the aim is to focus on the relationship between medium and form to frame some emerging controversies in the relationship between contemporary art and law. The central thesis consists in maintaining that contemporary art and the provocations it communicates as a stylistic code constitute a re-entry into the art system, which by virtue of its operational closure relaunches its own autopoiesis just as it irritates the legal environment.
