The Court of Cassation once again affirms the existence of the duty of health professionals to respect Jehovah’s Witness patient’s will to refuse a blood transfusion, even if it is life-saving. The duty to treat oneself — which may derive from moral obligations and responsibilities towards other persons — does not imply any legal right for the individual to preserve his/her own health, being the respect of one’s freedom and dignity more relevant.

La Cassazione ribadisce la sussistenza del dovere per i sanitari di rispettare la volontà del paziente — Testimone di Geova — di rifiutare la trasfusione di sangue anche nell’ipotesi in cui essa sia salvavita. Il dovere di curarsi — che può scaturire da obblighi morali e da responsabilità verso altre persone — non si traduce in alcun obbligo giuridico per il singolo di preservare la propria salute, essendo prevalente il rispetto della libertà della persona e della sua dignità
