The right to self-handling of port operations seems to have suffered strong compression, following the recent amendments to article 16 of Law No. 84/1994, made by article 199 bis of Law Decree 34/2020 (the so-called Relauch Decree), which caused an «involution» of the liberalisation prospects of the port services market. The article outlines the critical aspects of the recent regulatory reform and the obstacles it creates to the market of port services. In fact, the new regulation confines the self-handling regime of port operations to a residual role, in contrast not only with the principles underlying the reform made by Law Decree 34/2020, but also with domestic and European principles on competition and liberalisation of services.
Il diritto all'autoproduzione delle operazioni portuali sembra aver subito una forte compressione, a seguito delle recenti modifiche all'articolo 16 della Legge n. 84/1994, apportate dall'articolo 199 bis del DL 34/2020 (cd Decreto rilancio) , che ha determinato una «involuzione» delle prospettive di liberalizzazione del mercato dei servizi portuali. L'articolo delinea le criticità della recente riforma normativa e gli ostacoli che essa crea al mercato dei servizi portuali. La nuova disciplina, infatti, limita ad un ruolo residuale il regime di autoproduzione delle operazioni portuali, in contrasto non solo con i principi alla base della riforma operata dal DL 34/2020, ma anche con i principi nazionali ed europei in materia di concorrenza e liberalizzazione dei Servizi.
