Incoterms 2020: un aggiornamento in continuità con il passato

From January 1, 2020, the new Incoterms® 2020 of the International Chamber of Commerce are applicable. This new edition of the Incoterms® rules containing eleven commercial terms, presents some new elements with the introduction of some significant changes, although the overall system of the Incoterms® remained substantially unchanged compared to the previous 2010 edition. The new version of Incoterms® 2020 emphasizes the central role of the delivery of goods in the sales contract, and, consequently, the transfer of risk from seller to buyer, implicitly forcing some reflections on the misalignment between the trend of Italian court decisions and international trade practices.

Il contributo intende prendere in esame le novità introdotte dalla nuova edizione degli Incoterms 2020, attraverso l'analisi dell'evoluzione delle regole alla luce del lavoro interpretativo svolto dalla Camera di Commercio Internazionale (ICC) e le scelte adottate nell'ultima versione degli Incoterms tra esigenze di adeguamento alla realtà del commercio internazionale ed esigenze di consolidamento e di continuità con il passato.
