Felsina silente? I professori dell’Università di Bologna e il processo costituente

None of the professors of the University of Bologna took an active part in the drafting of the Italian Constitution, and only one of them (a geologist) was elected to the Constituent Assembly in 1946. Still, it would be naïve to think that they were not involved in the least in the long transition that resulted in the 1948 Constitution. Three sources have been scrutinized in order to piece together how far professors participated in the great public debate around the constitutional referendum and the new Constitution: records of the governing bodies of the Faculties and the University; local press; publicationsby the staff of the Faculty of Law, hypothetically the Faculty most interested in the drafting of a Constitution. As a matter of fact, just a few professors took active part in the discussion on the future fundamental laws of Italy: mostly those who had previously taken a tough stance against Fascism. Moreover, their attitude was usually inspired more by politics than by legal science. Jurists in particular appear reluctant to take sides: possibly because they were afraid of being out of tune with public opinion and the choices of the Constituent Assembly.

Benché l’Università di Bologna non esprima nessuno dei componenti della commissione dei 75, e non conti che un solo membro, non particolarmente attivo, dell’Assemblea Costituente, ciò non implica necessariamente una mancanza totale di coinvolgimento dell’Ateneo petroniano nel processo che porta alla Costituzione repubblicana. L’analisi condotta sugli atti degli organi collegiali, sulla stampa locale e sulla produzione scientifica dei docenti della Facoltà teoricamente più interessata al percorso di redazione di una nuova carta costituzionale (Giurisprudenza) permette di stabilire se e sino a che punto l’Università di Bologna rimanesse estranea al grande mutamento in atto. Nei fatti, emerge un coinvolgimento che è limitato quasi solo a chi era stato protagonista della Resistenza, o comunque aveva preso posizione contro il fascismo. Non solo: chi si esprime lo fa di norma sul piano esclusivamente politico, ben di rado entrando in quello tecnico, e nel merito delle scelte di carattere propriamente costituzionale. Spicca, soprattutto, una certa latitanza dei giuristi, che forse trova la spiegazione più plausibile in una mancanza di sintonia con le scelte poste in essere dal Paese e dai costituenti.
