The article analyses the judgment of the Italian Constitutional Court concerning the social security contribution exemption for working mothers introduced by the 2024 Budget Law, high-lighting its shortcomings in terms of equal treatment. While declaring the questions to be inadmissible, the Court points to the limited systemic coherence of the measure, which excludes fixed-term and domestic workers. The analysis focuses on the potential discriminatory effects of the scheme and on the Court’s self-restraint in the face of temporary and experimental legislative measures.
Il contributo analizza la sentenza della Corte costituzionale sull’esonero contributivo per le lavoratrici madri introdotto dalla legge di bilancio 2024, evidenziandone le criticità sotto il profilo della parità di trattamento. Pur dichiarando inammissibili le questioni sollevate, la Corte segnala la scarsa coerenza sistematica della misura, che esclude le lavoratrici a termine e domestiche. L’analisi riflette, in particolare, sui possibili profili di discriminazione e sul self-restraint della Corte di fronte a norme temporanee e sperimentali.
