Judgment 196/2024 rejected the question raised against Article 4, Paragraph 1 of Decree-Law 7/2024 (the provision that last intervened to define the size of the ceiling on mayors’ mandates), which: removed the ceiling for municipalities with up to 5,000 inhabitants; raised the ceiling for municipalities with populations between 5,001 and 15,000 inhabitants from two to three mandates; and reserved the prohibition on third mandates for municipalities with more than 15,000 inhabitants. The most interesting aspect of the decision derives from the fact that it dealt with an issue that questioned the definition of the height of the ceiling and only indirectly the problem of the ownership of the legislative competence to set it. Hence the question noted in the margin: what are the constitutional rules that bind the judgement on the reasonable balancing of the interests at stake?
