La tutela del minore dipendente da device nella prospettiva del best interest of the child

The contribution, by discussing a case of severe youth distress characterized by social isolation, intra- family aggressive behavior, and device addiction, explores the protection that must be ensured to the minor for the realization of his best interest. In this regard, the discussion covers both substantive and procedural aspects, with reference to the limitations of parental responsibility and the appointment of a special guardian. The reflections finally focus on the risks associated with the use of new technological tools by minors and on the related role of (educational) parental responsibility.

Il contributo, commentando un caso di grave disagio giovanile caratterizzato da isolamento sociale, condotte aggressive endofamiliari e dipendenza da device, approfondisce la tutela che deve essere garantita al minore per la realizzazione del suo superiore interesse. In questo senso, l’analisi è riferita sia all’ambito sostanziale sia a quello processuale con riguardo alle limitazioni della responsabilità genitoriale e alla nomina del curatore speciale. Le riflessioni si incentrano, infine, sui rischi connessi all’uso dei nuovi strumenti tecnologici da parte dei minori e sul connesso ruolo della responsabilità (educativa) dei genitori.
