As it is universally recognized, the overall quality level of university as an institution depends on the continuity with which the research and teaching activity is carried out by professors. On the contrary, the presence of a time limit compromises the reliability and development prospects of the university, also violating the standards that are promoted and shared in Europe as part of the Bologna Process. Following these premises, the contribution focuses on the legal aspects and repercussions of a provision with which a permanently employed professor in the Pontifical Urbaniana University was suddenly relieved of his academic duties through the application of a rule that is reserved for clerical and consecrated officials of the Roman Curia, for whom the service relationship ends due to the expiry of a pre-established time. The manifest profiles of illegitimacy and irrationality of this decision are therefore identified in order to finally point out how, if it were to become a government practice, it could seriously jeopardize the participation of ecclesiastical universities and faculties in the European space of higher education, which the Holy See joined in 2003.
Il livello di qualità complessivo dell’istituzione universitaria dipende, com’è universalmente riconosciuto, dalla continuità con la quale l’attività di ricerca e di insegnamento viene esercitata dal corpo docente. Al contrario, la previsione di un limite di durata compromette l’affidabilità e le prospettive di sviluppo dell’università, peraltro violando gli standards promossi e condivisi in Europa nell’ambito del Processo di Bologna. Sulla base di tali premesse, il contributo si concentra sugli aspetti giuridici e le ricadute di un provvedimento con il quale un docente stabilmente assunto nella Pontificia Università Urbaniana è stato sollevato improvvisamente dai suoi incarichi accademici applicando una norma riservata agli officiali chierici e consacrati della Curia romana per i quali il rapporto di servizio termina a causa della scadenza del tempo prestabilito. Si individuano, dunque, i manifesti profili di illegittimità e di irrazionalità di tale decisione per rilevare, infine, come essa, laddove assurgesse a prassi di governo, potrebbe seriamente mettere a rischio la partecipazione delle università e facoltà ecclesiastiche allo spazio europeo di istruzione superiore, al quale la Santa Sede ha aderito nel 2003.
