Problematiche concorrenziali nella gestione delle infrastrutture del trasporto. Autorità amministrative indipendenti a confronto

The sector of transport infrastructure management has always been affected, in our legal system, by problems related to the respect of competition, due to the difficulty, for the subjects operating in the transport market, to duplicate at sustainable costs the infrastructures instrumental to the performance of services. These problems have been addressed by the Italian Legislator through the involvement of independent public bodies, which were assigned functions of supervision and protection of competition on the one hand, and market regulation on the other. The roles and tasks of the Italian Anti-trust Authority and the Transport Regulation Authority thus tend to sometimes converge to the point of almost overlapping.

L’ambito della gestione delle infrastrutture del trasporto è sempre stato interessato, nel nostro ordinamento, da problematiche connesse al corretto operare della concorrenza, in ragione della difficoltà, per i soggetti attivi nel mercato del trasporto, di duplicare a costi sostenibili le infrastrutture strumentali allo svolgimento dei servizi. Tali aspetti sono stati affrontati dal legislatore italiano attraverso il coinvolgimento di enti pubblici indipendenti, cui attribuire funzioni di vigilanza e tutela della concorrenza da un lato e di regolazione del mercato dall’altro. Ruoli e compiti dell’Autorità Garante della Concorrenza e del Mercato e dell’Autorità di Regolazione dei Trasporti tendono, così, talora a convergere sino quasi a sovrapporsi.
