Genitorialità giuridica e genitorialità affettiva: nuove forme e funzioni dell'adozione

In the first part, the paper traces the legislative evolution of adoption regulatry system, dwelling on the different types into which it branches and highlighting the different functions to which, originally, these were aimed. In the second part, also through the light of the most significant jurisprudential decisions, the A. highlights the recent tendency to make normative models closer, in a convergent perspective towards the enhancement of so-called "social" or "intention" parenting. In this perspective, the adoption so called “in special cases” (Art. 44, Law 184/1983) is particularly ductile; it has already been used by jurisprudence to admit into our system the “Stepchild adoption” by same-sex couples and today it seems also useful to find an answer to the situation of so-called "semi-neglect" of the child, where the adoptive family does not replace, but stands alongside the child's original one, with a consequent coexistence and overlapping of different parenting origins, in part yet to be investigated.

Il saggio ricostruisce, nella parte iniziale, l’evoluzione normativa dell’istituto dell’adozione, soffermandosi sulle differenti tipologie nelle quali esso si dirama e ponendo in evidenza le differenti funzioni alle quali, originariamente, queste erano tese. Nella seconda parte, anche alla luce delle più significative decisioni giurisprudenziali, l’A. evidenzia come, in tempi recenti, stia emergendo una tendenza ad avvicinare alcuni modelli normativi, in un’ottica convergente verso la valorizzazione della c.d. “genitorialità sociale” o “di intenzione”. A tale prospettiva si presta, in particolare, l’istituto dell’adozione in casi particolari (art. 44, L. 184/1983), chiave già utilizzata dalla giurisprudenza per aprire le porte del nostro ordinamento all’adozione da parte del partner dello stesso sesso del genitore del minore ed oggi utile anche per trovare risposta alla situazione di c.d. “semiabbandono” del minore, ove la famiglia adottiva non si sostituisce, ma si affianca a quella di origine del minore, con una conseguenze coesistenza e sovrapposizione di genitorialità di origine differente, in parte ancora da indagare.
