Combined with nudge theory and libertarian paternalism, the concept of vulnerability seems to reveal two distinct and connected meanings: a descriptive one, coinciding with the constitutive vulnerability of the agent and a normative one, definable as the functional vulnerability of a nudged agent. The fact that the constitutive vulnerability enters the regulatory orbit of nudges as a descriptive basis for justi-fying paternalism counterintuitively entails that the agent should not overcome her vulnerability. This may compromise the libertarian credentials of nudging, its declared anti-perfectionism, but also the paternalistic function it was meant to perform.
