In 1962 Roland Barthes published a short semiological essay on faits divers, here analyzed as a founding text. After examining the literary-journalistic “practices” (news in three lines), this study is aimed at reconstructing the attempts made by André Gide to establish, in his recollections on the Assize Cour, the “gender” of the faits criminels. Besides, our goal is to clarify the definition given by Michel Foucault in Surveiller et punir (1975) of the contre-fais divers as a new type of legal documents.
