La gouvernance du Digital Services Act et la coopération des autorités

The Digital Services Act (DSA) is a new instrument through which the European Union (EU) aims at reaching primary constitutional goals. The rules established by means of this ambitious piece of legislation shall contribute to strengthening the European integration process in the face of the worldwide evolution of the powers exercised by very large online platforms and search engines. However, the failure or success of the DSA depend on the architecture and functioning of its governance systems. Therefore, the present article focuses on the key national and EU actors participating in the implementation mechanisms of the DSA. In particular, the analysis highlights the main cooperation schemes involving these authorities, especially in view of the need to better fundamental rights and European values in the digital sphere.

Il Digital Services Act (DSA) è un nuovo strumento attraverso il quale l’Unione Europea mira a raggiungere obiettivi costituzionali di primaria importanza. Le regole stabilite mediante questo ambizioso regolamento dovrebbero contribuire a rafforzare il processo di integrazione europea di fronte all’evoluzione dei poteri esercitati da grandi piattaforme online e motori di ricerca. Tuttavia, il fallimento o il successo dei DSA dipendono dall’architettura e dal funzionamento del proprio sistema di governance. L'articolo si concentra pertanto sui principali attori nazionali e dell’UE che partecipano ai meccanismi di attuazione della DSA. In particolare, l'analisi evidenzia i principali schemi di cooperazione che coinvolgono queste autorità, soprattutto in considerazione della necessità di proteggere diritti fondamentali e valori UE nella sfera digitale.
