Corruzione del parlamentare e mediazione onerosa nello specchio del chilling effect

The work aims to highlight how, in relation to some peculiar criminal offences, a 'strong' use of the principle of proportionality, in its dimension of a canon of criminal policy that imposes regulatory and interpretative statutes with a high coefficient of taxability, helps to control the risk of applicative overbreadth and to prevent the con- sequent 'chilling effect' of the exercise of constitutional functions to which the promotion of fundamental rights is linked. In this perspective, the relationship between the hypotheses of the parliamentary corruption and of the onerous mediation in the trafficking of illicit influences and the fundamental rights underlying the institutional functions they involve is addressed. In fact, the protection of the free exercise of parliamentary prerogatives, on the one hand, and of the methods of institutional action of the administration, on the other, may be excessively com- pressed in the event of the consolidation of interpretative paradigms that overstretch the operational area of the cases examined, in one case already affected by a lack of determinacy.

Il lavoro intende mettere in evidenza come, in relazione a talune peculiari fattispecie incriminatrici, un utilizzo ‘forte’ del principio di proporzionalità, nella sua dimensione di canone di politica-criminale che impone statuti normativi ed interpretativi ad alto coefficiente di tassatività, aiuti ad arginare il rischio di sovraestensioni applicative e a prevenire il conseguente effetto di ‘congelamento’ dell’esercizio di funzioni costituzionali cui è legata la promozione di diritti fondamentali (chilling effect). In questa prospettiva, viene affrontato il rapporto tra le ipotesi della corruzione del parlamentare e della mediazione onerosa nel traffico di influenze illecite e i diritti fondamentali sottesi alle funzioni istituzionali che esse intrecciano. La tutela del libero esercizio delle prerogative parlamentari, da un lato, e delle modalità dell’agire istituzionale dell’amministrazione, dall’altro, possono infatti subire compressioni eccessive in caso di consolidamento di paradigmi interpretativi che estendono oltremodo l’area operativa delle fattispecie esaminate, in un caso già ipotecate da deficit di determinatezza.
