Examines the role of common intentions in creating common intention constructive trusts (CICTs) in land, and suggests how current uncertainties stem from case law's failure to correctly identify that such trusts are founded in detrimental reliance and unconscionability. Reviews the distinction between the role of evidence of intention in rebutting a presumption of resulting trust and establishing an express trust, and the ambiguities over CICTs.
