Migrazioni e fattore religioso, tra tendenze securitarie e sfide del multiculturalismo. La cornice costituzionale

The article addresses the complex problem of the relationship between migration and the religious factor in modern multicultural democracies, with particular reference to the Italian constitutional order. Since the terrorist attacks of 2001, in fact, immigration policies have been increasingly constructed in the name of security protection, and less attention has been paid to the integration of migrants. This has also had consequences in terms of protecting the religious freedom of minorities, as evidenced by the most recent trends on the legislative, administrative and jurisprudential levels. Particular attention is given to the jurisprudence of the Constitutional Court, which has repeatedly indicated the need for the relationship between religious freedom and security to be based on a strict test of proportionality of legislative choices, in deference to the supreme value represented by human dignity.

L'articolo affronta il complesso problema del rapporto tra migrazioni e fattore religioso nelle moderne democrazie multiculturali, con particolare riferimento all'ordinamento all'ordinamento costituzionale italiano. A partire dagli attentati terroristici del 2001, infatti, le politiche migratorie sono state sempre più costruite in nome della tutela della sicurezza, e si è prestata minore attenzione all'integrazione dei migranti. Questo ha avuto conseguenze anche in termini di tutela della libertà religiosa delle minoranze, come dimostrano le più recenti tendenze a livello legislativo, amministrativo e giurisprudenziale. Particolare attenzione è data alla giurisprudenza della Corte Costituzionale, che ha ripetutamente indicato la necessità che il rapporto tra libertà religiosa e sicurezza sia basato su un rigoroso criterio di proporzionalità delle scelte legislative, in ossequio al valore supremo rappresentato dalla dignità umana.
