The article, after having reconstructed some lines of the international and Italian debate on commons and their legal discipline, examines in the light of the Roman sources the attempt to indicate in the Roman categories of goods removed from individual ownership possible models for the regulation of commons. Finally, two examples taken from medieval and modern history will be taken in consideration, which show how recourse to Roman categories of goods to model the discipline of current phenomena is an operation to be carried out with caution.
