The article analyses the most recent development of CJEU case-law about the concept of “normal regime”, which the Court refers to when applying the selectivity test in fiscal State aid matters. It focuses, in particular, on the only apparently antithetical cases of the rulings on progressive turnover taxes and the FIAT case. The analysis shows how case- law interprets the benchmark concept in such a way as to reaffirm the Treaty’s division of competencies in tax matters, as opposed to the expansive vis that the Commission seems to attribute to it.
Il contributo analizza la più recente evoluzione giurisprudenziale del concetto di regime normale, cui fa riferimento la Corte di Giustizia dell’Unione Europea nell’applicazione del test di selettività in materia di aiuti di Stato fiscali. Ci si sofferma in particolare sui casi, solo apparentemente antitetici, delle pronunce relative alle imposte progressive sul fatturato e quella sul caso FIAT. L’analisi evidenzia come la giurisprudenza interpreti il concetto di parametro di riferimento in modo tale da riaffermare il riparto di competenze in materia tributaria previsto dal trattato, in opposizione alla vis espansiva che la Commissione sembra attribuirgli.
