In the era of the gig economy, the traditional modulation of guarantees based on the nature of the employment relationship falters. Increasing favour is being accorded to regulatory models based on the general application of some of the main forms of protection traditionally reserved for subordinate employment and weak self-employment. This changed regulatory approach finds concrete experimentation in Law no. 128/2019 which, with regard to a specific category of platform workers (riders), introduced a set of protections of constitutional ancestry ranging from protection against discriminatory treatment to the protection of health and safety. After briefly describing the scope of the Law no. 128/2019, the Author focuses on the specific provisions concerning Inail insurance protection. In particular the A. investigates: the relationship with Articles. 1 and 4 of the t.u. Inail; the coordination with other legislative sources and the person responsible for the insurance obligation, in the light of the operating instructions of Inail; the amount of the insurance premium; the indemnity of events occurring outside the urban context and using means of transport other than those identified by Legislative Decree No 81/2015. In conclusion, a general assessment of the legislative intervention and the related application problems outside the work performed by riders is drawn.

Al cospetto della gig economy, la tradizionale modulazione delle garanzie in base alla natura del rapporto lavorativo vacilla. Un crescente favore è accordato nei confronti di modelli regolativi basati sulla generale applicazione di alcune delle principali forme di salvaguardia tradizionalmente riservate al lavoro subordinato ed a quello autonomo debole. Questo mutato approccio regolativo trova concreta sperimentazione nella legge n. 128/2019 che, con riguardo ad una specifica categoria di platform workers, ha introdotto un set di tutele di ascendenza costituzionale che spaziano dalla protezione contro trattamenti discriminatori alla salvaguardia della salute e sicurezza. Dopo aver ricostruito l’ambito di applicazione del predetto intervento legislativo, l’A. si sofferma sulle specifiche indicazioni riguardanti la tutela assicurativa Inail di cui ai commi 1 e 2 dell'art. 47 septies, d.lgs. n. 81/2015. Al centro dell’analisi giuridica si pongono diversi profili d’indagine: il rapporto con gli artt. 1 e 4 del t.u. Inail; il coordinamento con altre fonti legislative ed il responsabile dell’obbligo assicurativo, alla luce delle istruzioni operative dell’Inail; l’ammontare del premio assicurativo; l’indennizzabilità di eventi occorsi fuori dal contesto urbano e avvalendosi di mezzi di trasporto altri da quelli individuati dal d.lgs. n. 81/2015. In conclusione, si traccia un bilancio dell’intervento legislativo e dei relativi problemi applicativi al di fuori del lavoro svolto dai riders.
