L’idea di istituire un meccanismo di assistenza per l’approvvigionamento energetico modellato sull’operare del SURE ed il Regolamento (UE) 2022/2576 del Consiglio

The author analyses the problem that, following Russia’s use of its energy resources as a political weapon, the Commission has set itself to promote a mechanism for the supply of energy resources similar to the SURE, established to assist the Member States most affected by unemployment following the pandemic. Such a possibility is ruled out. In fact the latter mechanism could be set up internally in a very simple way. On the contrary as far as the energy sector is concerned, there is a need to take into account the traditions of each Member State cooperation with third States and to overcome them communitarising and concluding new international union agreements. Functional to that, without going against the attachment of each of the Member States to its national energy sovereignty, Regulation 2022/2576 provides for the establishment of a) a coordination of the demand and joint purchase of energy resources at the international level, and b) a service provider that organises the aggregation of these, procures from suppliers outside the Union the offers capable of satisfying the aggregated demand, and assigns access rights to them to the operators of each Member State in correspondence with what they have previously requested. The analysis is completed by pointing out that, unfortunately, in the final stage of the adoption of Regulation 2022/2576, the Member States obtained that the Council provide that the gas companies, which had positively participated in the aggregation of demand, may decide, contrary to what they had previously indicated, not to purchase the quantities previously requested.

L’autore analizza il problema che, a seguito dell’utilizzazione da parte della Russia delle proprie risorse energetiche come arma politica, la Commissione si è posta di promuovere per l’approvvigionamento di risorse energetiche un meccanismo – SURE – analogo a quello istituito dall’Unione per assistere gli Stati membri maggiormente colpiti dalla disoccupazione a seguito della pandemia. Una tale possibilità è esclusa in ragione del modo semplice in cui sul piano interno è stato possibile istituire quest’ultimo meccanismo, rilevando che per quanto riguarda il settore dell’energia s’impone l’esigenza di tener conto delle tradizioni di ciascuno Stato membro di avere rapporti di cooperazione con Stati terzi e di comunitarizzare ed integrare questi rapporti mediante nuove intese internazionali. Funzionale a ciò, senza andare contro l’attaccamento di ciascuno degli Stati membri alla propria sovranità energetica nazionale, il Regolamento 2022/2576 prevede l’istituzione a) di un coordinamento della domanda e dell’acquisto in comune di risorse energetiche sul piano internazionale e b) di un prestatore del servizio che ne organizza l’aggregazione, reperisce da fornitori esterni all’Unione le offerte atte a soddisfare la domanda aggregata ed assegna i diritti di accesso ad esse agli operatori di ciascuno Stato membro, in corrispondenza con quanto da essi precedentemente richiesto. L’analisi è completata evidenziando che, purtroppo, nella fase finale dell’adozione del Regolamento 2022/2576, il Consiglio, seguendo gli Stati membri, ha previsto che le imprese di gas, ancorché abbiano prima partecipato positivamente all’aggregazione della domanda, possano decidere di non acquistare i quantitativi prima richiesti.
