L’esercizio della giurisdizione civile e l’articolo 11 del Trattato lateranense alla luce di una recente pronuncia della Cassazione: vexatae quaestiones (non ancora) risolte?

The judgment under analysis attributes jurisdiction to the Italian Civil Court over a dispute arising out of the non-admission of a student to doctoral studies at the Pontifical Lateran University. La sentenza in esame attribuisce al Tribunale civile italiano la giurisdizione su una controversia sorta in seguito alla mancata ammissione di uno studente agli studi dottorali presso la Pontificia Università Lateranense. La decisione si inserisce in un filone interpretativo che tende alla progressiva erosione dello status normativo degli organi centrali della Chiesa cattolica (art. 11 del Trattato Lateranense). Il contributo delinea il caso e si concentra su due aspetti centrali. In primo luogo, illustra il quadro giuridico in cui si inserisce la Pontificia Università Lateranense, individuando le caratteristiche che la rendono un ente centrale della Chiesa cattolica e non solo ecclesiastico. Dall’altro lato, il contributo esamina l’atto compiuto dall’Università e, in particolare, la sua natura di interna corporis dell’Università Pontificia. Infine, vengono fornite alcune considerazioni conclusive sulle possibili conseguenze che questa pronuncia potrebbe avere sui futuri rapporti Stato-Chiesa in Italia.
