Fine pena (forse): ergastolo ostativo e prospettive di riscatto

The decree-law 162/2022 represents the epilogue of a long jurisprudential path, which has seen the reconstructive results of the judges of Strasbourg and the Italian Constitutional Court converge, united by the spirit of undermining the legitimacy of the life imprisonment without parole. After having reconstructed the conceptual structure that supports the position of the two Courts, the work examines the new legislation, highlighting the main problematic features and the convergence and divergence profiles with respect to the warnings formulated by the Italian Constitutional Court and the Court of Strasbourg.

Il d.l. 162/2022 rappresenta l’epilogo normativo di un percorso giurisprudenziale lungo e composito, che ha visto convergere gli esiti ricostruttivi dei giudici di Strasburgo e della Corte costituzionale, accomunati dallo spirito di scardinare le fondamenta di legittimazione dell’ergastolo c.d. ostativo, ponendone in luce i profili di illegittimità convenzionale e costituzionale. Dopo aver ricostruito l’impianto concettuale che sorregge la posizione delle due Corti in materia di ostatività penitenziaria, illavoro prende in esame la novella normativa, evidenziandone i principali tratti di problematicità e i profili di convergenza e divergenza rispetto ai moniti formulati dalla Consulta e dalla Corte europea.
