Profilazione elettorale e protezione dei dati personali: prospettive di soluzione in ambito europeo

Targeting techniques that involve the processing of personal data in the context of political advertising poses critical issues, as Cambridge Analytica case revealed. The EU Commission approved a specific proposal for a regulation on the transparency and targeting of political advertising, laying down rules to strengthen the protection of personal data in this area. Subsequently, these issues were affected by the approval of the Digital Services Act, which introduced rules on targeted advertising also applicable to political advertising. This essay examines the emerging solutions in the EU to the challenges posed by the targeting of political advertising, in particular considering the data protection rules established by the aforementioned proposed regulation and the impact of the DSA on these issues, highlighting the need to provide for further strengthening of these rules.
