The article highlights the crucial role played by European Legislation in guiding and orienting AI information systems applicable to human resources management. It focuses on the recent developments of the draft Directive on Platform workers and its practical impact on the evolution of AI market in a perspective of a better balance in a digital environment between constitutional values, such as the freedom of economic initiative and the safeguard of fundamental rights within the employment relationship. The “human-in-command” legislative approach should be firmly pursued to find new individual and collective rights to provide new compromises and enforceable instruments for workers, but away from an ideological rejection of AI and automated processes.
