Investimenti e sostenibilità ambientale nel contesto dell’EU-China Comprehensive Agreement on Investment (CAI)

The paper examines the sustainable development provisions, and particularly those related to the protection of the environment, set in the Comprehensive Agreement on Investment (CAI), the recent agreement concluded in principle by China and the European Union. After a brief reconstruction of the concept of environmental sustainability in the Chinese legal system, the analysis will provide an in-depth description of the content of Section IV of the CAI, focusing specifically on the part dedicated to investment and environmental protection. Lastly, some concluding remarks will be drawn on the effectiveness of the CAI provisions in achieving the objective of sustainable development that China and the EU included in the agreement.

Il contributo si propone di esaminare le disposizioni in materia di sviluppo sostenibile, in particolare quelle a tutela dell’ambiente, contenute nel Comprehensive Agreement on Investment (CAI), il recente accordo sugli investimenti concluso in linea di principio dalla Cina e dall’Unione Europea. Dopo una breve ricostruzione sul concetto di sostenibilità ambientale nell’ordinamento giuridico cinese, l’analisi sarà rivolta all’approfondita descrizione del contenuto della Sezione IV del CAI, soffermandosi in particolare sulla parte dedicata agli investimenti e alla protezione ambientale. Infine, saranno svolte alcune osservazioni conclusive circa l’efficacia delle disposizioni del CAI nel raggiungere l’obiettivo di sviluppo sostenibile che Cina e UE hanno incluso nell’accordo.
