La "riconversione mediatica" del fatto tipico

The paper focuses on the transfigurations caused by the phenomenon known as media justice on the structure of the crime and, in particular, on the category of tipicity. The author attempts to motivate the reasons why the result can only be that of a “media conversion” of the typical fact, cause of the organic mismatch between the media representation of the criminal offense and its constitutional paradigm.

Il contributo si concentra sulle trasfigurazioni causate dal fenomeno noto come giustizia mediatica sulla struttura del reato e, in particolare, sulla categoria della tipicità. L’autore tenta di motivare le ragioni per cui il risultato non può che essere quello di una “riconversione mediatica” del fatto tipico, in virtù dell’incompatibilità organica tra la rappresentazione mediatica dell’illecito penale e il suo paradigma costituzionale.
