Initially conceived as a commentary on a recent decision rendered by the “Grand Chamber” of the Italian Banking & Financial Ombudsman (Arbitro Bancario Finanziario), this article dwells on the place and role of amortization schedules in credit agreements, examining their (often implicit) effects on the amount of interests payable. Building on the EU Court of Justice’s most recent jurisprudence on consumer credit and more specifically on articles 5 and 10 (lett. f) of Directive 2008/48/EC, which mandate pre-contractual disclosure not only of the “borrowing rate” but also of “the conditions governing the application of the borrowing rate”, the author focuses on the level of transparency required be the law in order for the consent expressed by the borrower to qualify as truly “informed” and hence result in a legally binding agreement.

Lo scritto ricostruisce la struttura e la funzione dei piani di ammortamento nei contratti di finanziamento, esaminandone le ricadute (spesso implicite) sul processo di quantificazione del corrispettivo posto a carico del mutuatario. Passata in rassegna la più recente giurisprudenza della Corte di Giustizia europea sul credito al consumo, con particolare attenzione agli articoli 5 e 10 (lett. f) della Direttiva 2008/48/CE, che impongono un’informativa precontrattuale riferita non soltanto al “tasso debitore” ma anche alle “condizioni che ne disciplinano l’applicazione”, l’autore cerca di individuare il livello di trasparenza richiesto dal diritto – europeo e nazionale – non soltanto per poter considerare realmente “informato” il consenso espresso dal cliente, ma anche per scongiurare il rischio di un arbitraggio unilaterale sull’oggetto del contratto.
