Accesso alla giustizia in materia ambientale e climatica: le azioni di classe

This paper aims at verifying how class action can be an effective tool of protection from environmental damages. The analysis will involve, for the relevant profiles here, also climate litigation, which, although inevitably connected to the first, nowadays has its own autonomy. After reconstructing the main elements of environmental and climate litigations, the analysis focuses on the class action, in particular, about the object of trial and about the concept of « homogeneous rights ». Then, the above-expressed considerations are extended to the environmental and cli mate litigation. Moreover, it examines also the problem of the timeframe of law application. The study concludes, by stating that class actions can become an effective mean of access to justice in these sectors, it is necessary for the juridical operator to move away from considering the mass trial with the point of view of the relationship of two parties.
