La responsabilità degli amministratori di società partecipate da un socio pubblico

Looking back over the doctrinal and jurisprudential outcomes (especially since the ’90s at the time of writing - September 2017) on the jurisdiction, accounting or civil, which should be subjected to the liability of directors and statutory auditors of total or partial public participation, this paper intends to analyze the reasons for which also the provi sions of the recent regulatory intervention ex d.lgs. 19 August 2016, n. 175 represents, in a certain sense, a “missed opportunity”, not appearing suitable to overcome the many interpretative uncertainties.
