The concordatarian marriage: a topical or an anachronistic institution? In the first place, the essay dwells on the statistical data that show the dizzying decline in the celebration of marriages in Italy, in particular of concordatarian marriages, which are canonical marriages with civil effects. In addition to the desertion of Catholics, one can also recognize - on the one hand - a lack of attention by the ecclesiastical authority regarding the admonishing of the faithful about the obligation to make use of the civil effects of marriages that are celebrated in facie Ecclesiae, and - on the other hand - the acquiescence of the same ecclesiastical authority regarding the demolition of the exequatur of canonical judgments of marriage nullity at the hands of Italian jurisprudence, through the violation of the commitments that were assumed bilaterally. Such behavior appears very different from the efforts that were made in the past and in other circumstances, especially through the Concordats and after the refusal of the recognition of any competence of the Church in this regard by modern States, in order to guarantee at least a perfect uniformity between the spouse’s canonical and civil conditions. Against the apparent lack of interest for the current sunset of the concordatarian marriage, the essay supports the opinion - that is also explained by the means of some historical excursus - according to which both the institutional Church and the christifideles today have a duty of witness that is to be fulfilled precisely through this institution, which is a link and a hinge between ecclesial community and secular society. In fact, in front of the complete dissolution of civil marriage, this is the only institution that can make visible - and therefore propose erga omnes - that same marriage, substantially and immutably rooted in natural law, that canon law still keeps in its bosom.

Il saggio anzitutto si sofferma sul dato statistico che comprova il declino vertiginoso della celebrazione dei matrimoni in Italia, in particolare dei matrimoni concordatari. Oltre alla diserzione da parte dei cattolici si registra anche, su un versante, la scarsa preoccupazione dell’autorità ecclesiastica di ammonire i fedeli circa l’obbligo di avvalersi dell’efficacia nello Stato delle nozze celebrate in facie Ecclesiae, sull’altro l’acquiescenza della medesima nei confronti della demolizione dell’exequatur delle sentenze canoniche di nullità matrimoniale da parte della giurisprudenza italiana, in violazione degli impegni pattiziamente assunti. Un comportamento assai diverso rispetto agli sforzi nel passato e in altre circostanze compiuti per assicurare, specie tramite i concordati, dopo la negazione di ogni competenza della Chiesa al riguardo da parte degli Stati moderni, almeno la perfetta uniformità tra lo status canonico di coniuge e quello civile. Avverso l’attuale apparente disinteresse verso il tramonto del matrimonio concordatario, l’opinione sostenuta, argomentata anche attraverso alcuni excursus nella storia, è quella secondo la quale sia alla Chiesa istituzionale sia ai christifideles si imponga oggi un dovere di testimonianza proprio mediante questo istituto, anello di congiunzione e cerniera tra comunità ecclesiale e società secolare: dinanzi al totale dissolvimento del matrimonio civile esso solo può infatti rendere visibile - e quindi proporre erga omnes - quel matrimonio radicato sostanzialmente e immutabilmente nel diritto naturale che l’ordinamento canonico custodisce nel suo seno.
