Homobitransphobia not only constitutes a factor that hinders the development of human personality but also an attempt to democratic legal systems. The present contribution aims to investigate through comparison the different responses that institutions adopted to tackle anti-Lgbtq bias. Spain and Italy, for example, despite being legally and culturally similar, have taken diametrically opposed positions. This “difference in similarity” makes them two particularly interesting case studies. Special attention is given to international and supranational legal systems, too.
