IL TRATTAMENTO DEI DATI GENETICI TRA LIBERA CIRCOLAZIONE E TUTELA DELLA PERSONA

The article analyzes the issue of genetic privacy, placing the processing of personal data in the first place in the information society, which increasingly poses as a surveillance society.Through the reconstruction of the rules at European, international and national level and the analysis of the protection framework established by the personal data protection legislation, the issue of the balance between the protection of the person and the interests of society is analyzed in relation to the sharing of genetic data. The issue of balancing interests in relation to genetic privacy is also explored through the analysis of multilevel jurisprudence.In this regard, the most relevant areas of use of the same are analyzed, in particular that of research, in terms of health protection, in terms of lawfulness of processing and the rights of the data subject.

Il contributo affronta il tema del trattamento dei dati genetici nel quadro di protezione istituito dal regolamento generale per la protezione dei dati personali del 2016. In particolare, si sofferma sulle peculiarità di tali dati e sulla loro appartenenza a categorie particolari di dati, per cui valgono disposizioni di tutela più stringenti. Successivamente si occupa della privacy genetica siccome trattata e affrontata dalla giurisprudenza delle Corti europee in materia di protezione dei dati personali; infine affronta il tema della condivisione dei dati genetici tra finalità di interesse generale e tutela della dignità della persona
