The continuous improvement of market, forms of communications and advertising strategies for products intended for end-users constantly presents new challenges for consumer protection from commercial operators’ misleading conducts; in the field of food information accuracy, particularly, as a result of the multipurpose and multilevel nature of its discipline, it could be noted that some uncertainties still persist in the individuation of sure distribution criteria between AGCM competence and powers attributed to other bodies and authorities operating in the sector. In the absence of clear regulatory indications, both the Courts and the internal Legislator have shown ambiguous approaches to this matter, often influenced by contingencies or uncertain interpretations; nevertheless, the issue still remains crucial, especially with regard to sanctioning powers, in order to assure the best protection for consumers and their freedom of choice in the context of a harmonised and competitive market.
