Una finestra, un cortile, una monaca. Un famoso passo manzoniano «sub speculo iuris».

Le circostanze del primo, fatale incontro fra la Monaca di Monza e il giovane e sfaccendato nobilotto Egidio (uno sguardo malizioso e una parola di troppo pronunciata dall’alto di una finestra affacciata sul cortile del convento), si prestano a una rilettura sub speculo iuris. Secondo una consolidata communis opinio ancora in osservanza nel Seicento, il secolo de I promessi sposi manzoniani, quella finestra non doveva esserci o, per meglio dire, avrebbe potuto non esserci se il dante causa fosse stato in grado di dimostrare in giudizio che essa era stata aperta all’esclusivo fine di violare con sguardo malizioso l’intimità della clausura. According to a long-lasting communis opinio, which was still in force in the Century (XVIIth) of I promessi sposi – the masterpiece of Alessandro Manzoni –, a window like that had not to be there. Or, it is better to say, it ought to have been removed if the litigant proved to the Court that the window had been built for the exclusive and malicious reason of violating the sacred privacy of the nuns.
