This paper investigates the extent to which artificial intelligence is able to respond to the need of predictability — and, therefore, ultimately, equality — of sentences. After reconstructing the European law on the subject, paying specific attention to the proposed draft of law on artificial intelligence, the analysis focuses on the weaknesses and strengths of the robotic systems within the civil process. This study, therefore, allows us to conclude that artificial intelligence, even if it contributes to a better efficiency of the justice system, will never be able to totally overcome the unpredictability of the decision, since it is a natural element of the law.

Abstract
This paper investigates the extent to which artificial intelligence is able to respond to the need of predictability — and, therefore, ultimately, equality — of sentences. After reconstructing the European law on the subject, paying specific attention to the proposed draft of law on artificial intelligence, the analysis focuses on the weaknesses and strengths of the robotic systems within the civil process. This study, therefore, allows us to conclude that artificial intelligence, even if it contributes to a better efficiency of the justice system, will never be able to totally overcome the unpredictability of the decision, since it is a natural element of the law.File | Dimensione | Formato | |
