Tra aurora e crepuscolo: un breve itinerario nei diritti a base religiosa sul terreno della bioetica

Using the tool of the legal comparison, the present study aims to illustrate the main bioethical issues within Jewish, canonical and Muslim law for the purpose of analysing the limits that the three sacred rights place on today’s technical possibility. In particular, the article starts with investigating the auroral life of the fertilized egg and the embryo and it concludes with the crepuscular life of the dying person. By highlighting harmonies and disharmonies between the three religious rights and within them, the reader has the opportunity to walk along the paths of a forest made up of responsa from the rabbinic authorities, magisterial pronouncements and fatawa of Muslim jurists.

Impiegando il metro della comparazione giuridica, il presente studio si propone di illustrare le principali problematiche di bioetica all'interno del diritto ebraico, canonico e musulmano, con lo scopo di vagliare i limiti che i tre diritti sacri pongono all'odierno possibilismo tecnico. In particolare, il contributo si avvia analizzando la vita aurorale dell'ovulo fecondato e dell'embrione per poi concludere con quella crepuscolare del morente. Mettendo in luce armonie e disarmonie tra i tre ordinamenti religioni e in seno agli stessi, si dà al lettore la possibilità di camminare lungo i sentieri di una selva composta da responsa delle autorità rabbiniche, pronunciamenti magisteriali e fatawa dei giurisperiti musulmani.
