The paper examines the judgment no. 2 of 2022 issued by the Italian Constitutional Court, called to assess the constitutionality of article 670 of the Code of Criminal Procedure, with the main aim of remedying, although indirectly, an injustice that occurred in a case dating back many years. The judgment of the Court is an opportunity to reflect on the errors that have accumulated in the trial and the appeal stage, and on the causes that have produced them (related to what has been called the "habit" to judge), trying to reflect on how they can be remedied. The thesis submitted by the authors is that in cases of negotiated justice, and in particular in plea bargaining, more attention should be paid to the errors that may affect the consent expressed by the defendant, a problem sometimes neglected by case law, and in relation to which reference to private law categories may offe some viable solutions for criminal matters.

Il contributo analizza la sentenza n. 2 del 2022, con la quale la Corte costituzionale è stata chiamata a decidere sulla legittimità costituzionale dell’art. 670 c.p.p., con il fine - indiretto sì, ma primario - di rimediare a una ingiustizia, verificatasi in un caso risalente a molti anni addietro. La sentenza della Corte costituisce l’occasione per ripercorrere gli errori che, nel processo di merito, si sono accumulati, e sulle cause che li hanno provocati (legate a quella che è stata definita la “assuefazione” al giudicare), per cercare di riflettere su come ad essi possa essere posto riparo. La tesi è che, nei casi di giustizia negoziata, e in particolare nel patteggiamento, occorra prestare maggiore attenzione agli errori che si possono annidare nel consenso espresso dall’imputato, problema non di rado trascurato dalla giurisprudenza, in relazione al quale il riferimento alle categorie civilistiche può offrire qualche soluzione anche in campo penale.
