La vita a comando

The essay considers the separation, which has now taken place, between sexuality and procreation; and the progressive shift of human reproductive processes under the technical domain: medicine and biomedical engineering. A step on this path is represented by surrogacy and the problems posed by parenthood of the same sex. Law is crossed and questioned by these passages towards a new world: and this contribution analyzes the latest developments in Italian and European jurisprudence on the subject.

Il saggio considera la separazione, ormai avvenuta, tra sessualità e procreazione; e il progressivo spostamento dei processi riproduttivi umani nell'ambito tecnico: medicina e ingegneria biomedica. Un passo in questo percorso è rappresentato dalla maternità surrogata e dai problemi posti dalla omo-genitorialità. Il diritto è attraversato e messo in discussione da questi passaggi verso un mondo nuovo: e questo contributo analizza gli ultimi sviluppi della giurisprudenza italiana ed europea in materia.
