Il legato di libri e l’interpretazione della voluntas testatoris

The legacy of books is an interesting occasion to investigate about the typical interpretation, based on the verba, and the individual one, based on the voluntas. The reconstruction of testator’s purpose, whenever the legacy is not clear enough, appears even more delicate and difficult than the usual by the evolution of publishing, so that it becomes preliminary for the jurists to define the concept itself of book. It is particularly important a text of Ulpian, D. 32.52: the jurist considers useful several guide-lines like testator’s subjective linguistic usages and customs of life, the personal value he attached to his books and their functional relationship to the place where they were.

Il legato di libri costituisce un’interessante occasione per interrogarsi sul delicato rapporto tra interpretazione tipica, basata sui verba, e interpretazione individuale, fondata sulla voluntas. La ricostruzione, laddove la disposizione mortis causa non sia sufficientemente chiara, appare ulteriormente complicata dal susseguirsi delle novità della tecnica editoriale che determina la necessità di definire in via preliminare il concetto stesso di libro. I criteri utili all’interpretazione della voluntas testatoris vengono rinvenuti in parametri estrinseci, come le personali consuetudini linguistiche e le abitudini di vita del defunto, il valore non solo patrimoniale, ma anche quello del tutto personale che i libri avevano per il de cuius, con ulteriore riguardo all’uso che il testatore faceva in vita dei libri legati nonché al rapporto funzionale impresso dal dominus con il luogo in cui sono ubicati. In linea generale, le proposte interpretative si pongono nel segno della massima valorizzazione della voluntas testatoris, trovando come limite invalicabile, normativamente imposto, la salvaguardia dell’integrità del patrimonio artistico-culturale urbano.
