Jefferson e la separazione del potere

Thomas Jefferson’s reflection on public institutions is deeply influenced by the central role assumed in his thinking by individual rights. The protection of rights is in fact the end and limit of the powers conferred on governments and profoundly affects, in Jefferson’s thought, the structure that power itself must assume. From this primacy of rights derive Jefferson’s reflections on political representation, on the separation between legislative, executive and judicial powers, on the necessary popular investiture of the latter and, last but not least, on the vertical separation of power between federal, state and local governments.

La riflessione di Thomas Jefferson sulle istituzioni pubbliche è profondamente influenzata dal ruolo centrale assunto nel suo pensiero dai diritti individuali. La tutela dei diritti è infatti il fine e il limite dei poteri conferiti ai governi e influenza profondamente, nel pensiero di Jefferson, la struttura che il potere stesso deve assumere.
