La società fra conviventi

The essay illustrates the type of business of the cohabitant and / or cohabitants, having particular regard to the legislative framework. In this perspective of analysis, the author – after in-depth preliminary considerations – focuses on the partnership between cohabitants, illustrating the shareholder cohabitation agreement. Lastly, he addresses the issue of exceptions to the discipline of shareholder agreements and the enforceability of cohabitation agreements against third parties.

Fra le ipotesi di esercizio dell'impresa da parte di uno o più conviventi, desta particolare interesse la fattispecie della società fra conviventi, rispetto alla quale pare necessario comprendere se siano configurabii deroghe - facoltative o necessarie - alla disciplina generale del tipo sociale di riferimento e se si possa ipotizzare la stipula di contratti di convivenza parasociali opponibili ai terzi.
