The article examines peculiarities of remote work in the Italian and Spanish legal systems, highlighting the relationship between the different regulatory sources and the role of collective bargaining. In Spain, as a result of the pandemic, a comprehensive regulation of remote work is enacted, with Royal Decree-Law n. 28/2020, in which the distance work agreement becomes the center of the distance work relationship and where collective bargaining acquires a fundamental value to guarantee the balance between the parties in the employment relationship; this regulation could constitute a valid example also for a forthcoming new intervention by the Italian legislator.

Abstract
