Verso un recesso de facto della Polonia dall’Unione europea?

The judgment of the Polish Constitutional Tribunal of 7 October 2021, establishing a general incompatibility of the European Treaties with the Polish Constitution, represents not only an escalation in the dispute between the European Union and Poland on the question of respect for the rule of law, but also a formal step by Poland towards its abandonment of the Union. The final withdrawal could take place in an ‘orderly’ manner by notifying the European Council of the outcome of the judgment in question, pursuant to Article 50(2) TEU. But, it could also take place through a de facto withdrawal of Poland, effected through a systematic disapplication of European law in favour of national law. In such circumstances, the Union could only take note of Poland’s departure from the ‘common house’. Although undesirable, this de facto withdrawal would not be incompatible with the European Treaties.

La sentenza del Tribunale costituzionale polacco del 7 ottobre 2021, stabilendo una incompatibilità generale e di principio dei trattati europei con la Costituzione polacca, rappresenta non solo una escalation nella controversia tra Unione europea e Polonia sulla questione del rispetto dello Stato di diritto, ma anche un passo formale della Polonia verso il suo abbandono dell’Unione. Il recesso definitivo potrà avvenire in maniera ‘ordinata’ mediante la notifica al Consiglio europeo dell’esito della sentenza in questione, ai sensi dell’art. 50, par. 2 del TUE. Ma, potrebbe avvenire anche attraverso un recesso de facto della Polonia, effettuato attraverso una sistematica disapplicazione del diritto europeo a favore del diritto nazionale. In tali circostanze l’Unione non potrebbe che prendere atto dell’allontanamento della Polonia dalla casa comune. Per quanto non auspicabile, questo recesso de facto non sarebbe incompatibile con i trattati europei.
