The a. evaluates whether the technical aspects of the decision should acquire a key role in the process or not, considering that consultancy activity is often “at most tolerated” in the procedure due to reasons of expediency and simplification. The a. comes to the conclusion that the technical aspects remain sacrified even in the process, because of the inhomogeneity of the judge’s decisions on technical evaluations combined with the poor use of the official technical consultancy.
