Alle radici dell’affiliazione. L’emersione delle pratiche paraadottive nel codice civile del 1942

The essay investigates the introduction in the Civil code of the institution of affiliation as an expression of the European phenomenon of the so-called customary ‘para-adoptive’ practices, from the Middle Ages to the Ancient Regime, intended to perform a wide range of functions through the factual reproduction of a parental bond. The need for an institution that, without demanding all the requirements for the adoption and without achieving all the effects, would govern these ‘almost familiar’ situations became even more urgent following the catastrophic events at the turn of the 19th century and the beginning of the 20th century. The high number of orphans due to earthquakes or wars, and of ‘foundlings’ welcomed and raised in families highlighted the unfortunate need to overcome the boundaries of the adoptive institution, as outlined by the 1865 Code, for welfare purposes and to provide juridical protection to these ‘chosen children

Il saggio indaga sull’introduzione codicistica della affiliazione quale espressione del fenomeno europeo delle c.d. ‘pratiche paraadottive’ consuetudinarie, dal Medioevo all’Antico Regime, destinate ad assolvere ad un ampio arco di funzioni tramite la fattuale riproduzione di un legame genitoriale. La necessità di un istituto che, senza esigere tutti i requisiti dell’adozione e senza raggiungerne tutti gli effetti, disciplinasse queste situazioni ‘quasi familiari’ divenne ancora più impellente a seguito degli eventi catastrofici a cavallo fra fine ’800 e inizi ’900. L’alto numero degli orfani per terremoti o guerre, e dei ‘trovatelli’ accolti ed allevati nelle famiglie evidenziò l’incresciosa esigenza di superare i confini dell’istituto adottivo, come delineati dal codice del 1865, a fini assistenziali e di dare una tutela giuridica a questi ‘figli d’elezione’
