The aim of this reflection is to critically examine the Italian jurisprudence regarding the use of the mechanographic systems deployed by the public administration, with particular reference to the recent judgments passed by the Regional Administrative Court and the Council of State. Even by resorting to algorithmic systems in procedures that require a large number of administrative documents and involve a significant group of subjects, the principles of the administrative procedure can be guaranteed to protect the legal situations of the data subjects. Therefore, the algorithm must be considered an IT administrative act, and as such, its access, motivation and review must be guaranteed to the administrative judge. The use of the algorithm is limited to administrative acts that have no discretion: in this regard, the issue of technical discretion must now be considered a prototype of the notion of discretion. The concept of technical discretion is expressed in the sense that complex issues must be resolved through reference to the so-called ‘hard sciences’.
Una riflessione con occhio critico, all'uso dei sistemi meccanografici da parte della P.A., in particolare dei TAR e del Consiglio di Stato. Anche ricorrendo a sistemi algoritmici possono essere garantiti i principi del procedimento amministrativo. Pertanto l'algoritmo è un atto amministrativo informatico e, in quanto tale, se ne deve garantire l'accesso, la motivazione nonché il sindacato del giudice amministrativo. L'utilizzo dell'algoritmo è limitato agli atti amministrativi che non residuano alcuna discrezionalità: il tema della discrezionalità tecnica deve ormai essere considerato quale prototipo della nozione discrezionalità, concetto che si esplica nel senso che i fatti complessi devono essere risolti attraverso il rinvio alle "scienze dure".
