Malum in se. L'intrinseca incompatibilità tra Stato di diritto e tortura legale.

The aim of this essay is to provide an overview of the contemporary philosophical-legal debate, concerning the theme of the legalization of torture. Starting with an historical and philosophical perspective, it is highlighted that the instances proposed by the theorists supporting the introduction of forms of “legal torture” are far from and contrary to the foundational principles of modern legal systems. Moreover, the persistent presence of torture in human history it is nothing but a warning. Torture, in fact, is not only a "necessary object of criminal law", but also an issue which "concerns us" and it is investigated by Philosophy, at least as much as by the Law.

Lo scopo di questo contributo è quello di proporre una panoramica del dibattito giusfilosofico contemporaneo concernente il tema della legalizzazione della tortura. Adottando una prospettiva storica e filosofica, si mira ad evidenziare quanto le istanze atte a sostenere l’introduzione di forme di “tortura legale” siano profondamente distanti e contrastanti con i principi che sorreggono gli ordinamenti giuridici. Inoltre, la perdurante presenza della tortura nella storia dell’umanità altro non è se non un monito imprescindibile. La tortura, infatti, non è solamente un “oggetto necessario del diritto penale”, ma anche un tema che “ci riguarda” ed interessa la filosofia, almeno quanto il diritto.
