Il contratto e l’interprete

The article, starting from the acquired acknowledgment of the growing complexity and the consequent process of fragmentation that has come about, aims to highlight the growing role of the scholar in the interpretation of the contractual system. This approach is mainly underlined because of the increasingly recurrent use – not exempt from criticism – of the general clause of good faith and, more recently, of the direct application of the constitutional principle of solidarity.

Il contributo, preso atto della crescente complessità e del conseguente processo di frammentazione venutosi a determinare, intende porre in luce l’accresciuto ruolo dell’interprete al cospetto del sistema contrattuale. E ciò principalmente in ragione dell’utilizzo sempre più ricorrente – per vero non esente da critiche – della clausola generale di buona fede e, in epoca più recente, dell’applicazione diretta della solidarietà costituzionale.
